1. What Terms and Conditions apply to my Vodafone Combo Cap and Vodafone Infinite Combo Plan?
(a) This document sets out the terms and conditions which apply to specific Vodafone contracts and products (collectively, the "Products").
(b) The terms and conditions that will apply to your Product or Products are:
(i) all the terms and conditions provided to you when you agree to purchase a Product, including all the terms and conditions contained in this document and any terms and conditions contained in any application form you complete when purchasing a Product; and
(ii) all the terms and conditions contained in the Vodafone Standard Form of Agreement (SFOA), which is available at vodafone.com.au,
(c) When you agree to purchase a Product you accept the Terms.
(d) Your contract commences on your acceptance of the Terms, however any minimum contract term which applies does not commence until your service is activated.
(e) The Terms may be changed by Vodafone from time to time. Vodafone will comply with relevant laws, regulations and industry codes if it makes any such changes.

2. Important Things You Need to Know
Availability
(a) The Vodafone contracts and products referred to in the Terms (Products) are for personal use only, and are not available to medium to large business/corporate and commercial customers. Medium to large business/corporate and commercial customers should contact Vodafone for information about Vodafone's business products.
(b) The Products referred to in the terms are only available on selected devices and handsets as nominated by Vodafone.
(b) The Products are available to eligible customers and credit approved customers, only.
(c) Unless otherwise stated, only one Vodafone Product can be used per connection to our network.
(d) Vodafone's Fair Use Policy applies to all Vodafone Products.
(e) Devices may be locked to our network. A fee may apply to unlock.
Factors affecting availability and performance
(a) Network coverage and many other factors may affect the availability and performance of certain Products.
(b) Certain Products, services and functions are only available if used in conjunction with a compatible device and if in a compatible coverage area. Not all devices are compatible with our network.
(c) All Vodafone services are subject to device capabilities and network limitations and availability. A compatible 3G device is required to access 3G services. If you have a handset which is U2100MHz or U2100/850MHz compatible but not U900MHz compatible you will experience 3G coverage in metro areas (3G Mobile Broadband Standard Coverage area and, if available for your handset, the 850 Mobile Broadband Coverage area) and 2G (2.5G GPRS or 2.75G Edge) in all other coverage areas. If you have a modem which is U2100MHz or U2100/850MHz compatible but not U900MHz compatible you will experience 3G coverage in metro areas (Vodafone 3G Mobile Broadband Standard Coverage area and, if available for your modem, the Vodafone 850 Mobile Broadband Coverage area) but no coverage at all in other areas of Australia. Broadband speeds and high bandwidth applications, such as video streaming, video calling, Mobile TV and full track downloads, are only available in Vodafone�s 3G Mobile Broadband Standard Coverage area; and, if you have a U850MHz compatible device, in Vodafone's 850 Mobile Broadband Coverage area; and, if you have a U900Mhz compatible device, Vodafone�s 3G Mobile Broadband Regional Coverage area (however speeds in Vodafone�s 3G Mobile Broadband Regional Coverage area will be slower than when in Vodafone�s 3G Mobile Broadband Standard Coverage area or, if available for your device, Vodafone's 850 Mobile Broadband Coverage area). You agree to refer to www.vodafone.com.au/coverage for coverage details and vodafone.com.au/devicefrequency for details of devices and their frequencies before purchase, so that you can confirm that for your intended use of the services, your address/es are located in the appropriate Vodafone coverage areas and that the device you wish to select is compatible with the Vodafone coverage area where your address/es are located
(d) The Terms and brochures describing Products contain details regarding device compatibility, network capability and availability relating to the "Vodafone" network. Notwithstanding anything else in our contract with you, we may provide services to you using any telecommunications network we consider appropriate and that network will constitute "our network" for the purpose of the Terms, including (but not limited to) the "Vodafone" networks operated by, for or on behalf of Vodafone Network Pty Limited and Vodafone Australia Pty Limited and the "3" network operated by, for or on behalf of Vodafone Hutchison Australia Pty Limited. Data services
(a) For data Products, a data session starts when you first connect to data services and ends when you disconnect from data services.
(b) When using data Products, some internet services, including web sites and email, may not be accessible.
(c) Subject to your rights under the Trade Practices Act 1974 or other relevant legislation, Vodafone does not make any warranty regarding any software or data provided to you, including with respect to how that software or data operates on your computer or interacts with your other applications.
(d) Unless otherwise stated, data usage is measured as the combination of both data you send (upload) and receive (download) over our network.
Data service access devices
(a) It is your responsibility to confirm that data service access hardware (including any Modem or Pocket WiFi™ device) is compatible with each PC, laptop or other computing device that you will use your Product with (if appropriate).
(b) Non-Vodafone supplied USB Modems or Tablet devices can only work on our network if they are compatible, unlocked, and have not been reported as lost or stolen devices.
(c) Vodafone is not required to provide you with technical support if you use non-Vodafone supplied data service access hardware (such as your own USB Modem or Tablet device), although Vodafone may do so at its discretion.
(d) The Pocket WiFi™ device can operate with a maximum of 5 WiFi enabled devices at any one time.
Rates and charges
(a) Some Products have a minimum contract term. If your contract is terminated before the end of this term, both mobile and mobile broadband services will end. You may also be required to pay fees, such as an Early Exit Fee or a Handset Recovery Fee. Depending on the Product this may be in addition to any applicable handset or device payments and additional or excluded call, data or service costs. Early Exit Fees are set out in the pricing table for your Product.
(b) Details of the rates and charges, including any minimum spends which apply to the Products, are contained in the Terms. The minimum total cost over contract term is calculated by multiplying the minimum monthly spend by the contract term.
(c) If your usage of a Product exceeds your included value, or you use a Product that is not payable from your included value, you will be charged an amount additional to your minimum monthly spend.
(d) Unless otherwise stated, if you do not use all your included value in the relevant month, that included value is forfeited, is not refundable, and will not carry over into any other month.
(e) Each charge is rounded up to the nearest cent before GST is included.
(f) All rates and charges are subject to change. We will comply with relevant regulations and industry codes with respect to such changes.
Billing
(a) In your first bill, you will be charged your minimum monthly spend for the following month. Your first bill may also include a prorated amount from the date you connected to your first bill.
(b) You may choose to purchase additional Products from time to time. These charges will be applied to your bill.
(c) Paperless billing is the default bill delivery method for Vodafone customers. Vodafone will provide paper bills without charge to disabled or disadvantaged customers. Otherwise, Vodafone will not provide paper bills except in special circumstances, in which case, at its discretion, Vodafone may charge $2.20 per paper bill.
(d) Your Included Data may appear on your bill as two separate entries (for example, for the Vodafone $15 Month to Month Mobile Broadband Product, the 1.5GB of included data may appear on your bill as one entry of 1GB and a second entry of 500MB).

The following terms and conditions apply to you if you purchase a Vodafone Combo Cap or Vodafone Infinite Combo Plan Product:
(a) Data allowances can only be used in Australia, on Vodafone networks. Data usage outside Australia is charged at an International Data Rate of1c per KB (minimum session 10KB).
(b) The Minimum Monthly Spend is payable for each full monthly billing cycle in advance and is non-refundable. All other charges are billed at the end of the monthly billing cycle in arrears.
(c) You will be issued with two SIM Cards � a Handset SIM Card and a Mobile Broadband SIM Card. The Handset SIM Card is for use in the handset provisioned with your Vodafone Combo Cap or Vodafone Infinite Combo Plan Product and the Mobile Broadband SIM Card is for use in the USB Modem or Pocket WiFi™ device provisioned with your Vodafone Combo Cap or Vodafone Infinite Combo Plan Product.
(d) You will be allocated a Monthly Included Handset Value which will vary depending on which Combo Cap or Vodafone Infinite Combo Plan Product you purchase. Your Included Handset Value is only available for use via your Handset SIM Card and is not available for use via your Mobile Broadband SIM Card.
(e) Usage of services via your Handset SIM Card (not Mobile Broadband SIM Card):Unless otherwise stated, the section below titled "Payable from Included Handset Value" specifies which Products are available to be used from your Included Handset Value via your Handset SIM Card and the rate at which additional services will be charged, and the section below titled "Not payable from Included Handset Value" specifies products which cannot be used from your Included Handset Value via your Handset SIM Card and the additional rate at which you will be charged, if you use those services via your Handset SIM Card.
(f) Usage of services via your Mobile Broadband SIM Card (not Handset SIM Card): Any non-data use via your Mobile Broadband SIM Card (eg voice calls, SMS/MMS and content) is charged in addition to your Vodafone Combo Cap or Vodafone Infinite Combo Plan Product minimum monthly spend. Refer to Section 4 "Rates and Charges for Non-Data Use via Your Mobile Broadband SIM Card provisioned with a Vodafone Combo Cap or Vodafone Infinite Combo Plan Product" for further details.
(g) Your "Included Mobile Broadband Data" and "Included Mobile Internet Data" are separate. When you access data services via your Mobile Broadband SIM Card, usage will be deducted from your Included Mobile Broadband Data. When you access data services via your Handset SIM Card, usage will be deducted from your Included Mobile Internet Data.
(h) You will receive an Included Mobile Internet Data or Unlimited BlackBerry� Email and Internet browsing (BlackBerry� Internet Service (BIS version) allowance unless your Product is the $29 Combo Cap Product or the $45 Vodafone Infinite Combo Plan Product, where the Unlimited BlackBerry� Email and Internet browsing allowance is not available.
(i) If you exhaust your Included Mobile Broadband Data, you will be charged for additional usage of data services via your Mobile Broadband SIM Card at the rate of 2c per MB (charged per KB) within Australia. If you exhaust your Included Mobile Internet Data, you will be charged for additional usage of data services via your Handset SIM Card at a rate of 50c per MB (minimum session 12KB). Additional data charges cannot be paid from your Included Handset Value (regardless of whether they are incurred via your Mobile Broadband SIM Card or your Handset SIM Card).
(j) If you have chosen to include Unlimited BlackBerry� Email and Internet browsing with your $49 or $69 Combo Cap Product, or $65, $85 or $100 Vodafone Infinite Combo Plan Product, sections 6(d) � (i) below also apply to you.
(k) Any $0 upfront or discounted device offers are only available from Vodafone's selected device range at the time that you agree to a contract and cannot be redeemed for cash or as a credit against your service costs with Vodafone. These mobile device offers are not available if you switch between contracts during the Minimum Contract Term.
(l) Unless otherwise stated, call usage is billed in blocks of 30 seconds for Vodafone Infinite Combo Plan Products and 60 seconds for Vodafone Combo Cap Products. Usage is rounded up to the end of the current block.
(m) You may suspend your contract for between 1 and 3 consecutive calendar months once during the minimum contract term. You will be charged a fee for each month if your contract is suspended. Your minimum contract term will be extended by the period of any suspension.
Payable from Included Handset Value � Vodafone Combo Cap & Vodafone Infinite Combo Plan Products
This table details all Products that can be paid from your Included Handset Value (unless stated otherwise), and the charge rate for those Products. If a Product's price is "unlimited", you will not be charged for that Product.
If you ever exhaust your Included Handset Value, you will be charged an additional amount for all additional Products you use at the rates specified in this table.

4. Rates and Charges for Non-Data use via a Mobile Broadband SIM Card provisioned with a Combo Cap or Vodafone Infinite Combo Plan Product.
Not payable from Included Value
For Vodafone Combo Cap and Vodafone Infinite Combo Plan Products, all non-data use via your Mobile Broadband SIM Card is excluded from your Vodafone Combo Cap or Vodafone Infinite Combo Plan Product and will be charged in addition to your minimum monthly spend. You will be charged an additional amount to use these Products at the rates specified in the below table. These additional amounts cannot be deducted from your Included Handset Value.

A. Vodafone Combo Cap or Vodafone Infinite Combo Plan Bolt-On Products are only available to customers who are connected and remain connected to a valid Vodafone Combo Cap or Vodafone Infinite Combo Plan Product.
B. Included Mobile Broadband Data allowance is only available for use via your USB Modem or Pocket WiFi™ device (as applicable). It is not available for use on your handset.
C. Included Data allowances can only be used in Australia, on Vodafone networks.
D. If you exhaust your Included Data allowance, additional data usage will be charged at the Additional Data Price � Australia rate.
E. Data usage outside Australia is charged at the Additional Data Price � International rate.
F. Cancellation will take effect from the end of the month on which you tell us that you want to stop receiving the Combo Cap or Vodafone Infinite Combo Plan Bolt-On Product. You will be billed until the end of that month.

The following terms and conditions apply to you if you purchase an Unlimited BlackBerry® Email and Internet browsing Pack Product:
A. Vodafone Unlimited BlackBerry® Email and Internet browsing Pack Products are available to you if you are connected and remain connected to a valid Vodafone Combo Cap or Vodafone Infinite Combo Plan Product. If your Vodafone Combo Cap or Vodafone Infinite Combo Plan Product is cancelled, your Unlimited BlackBerry® Email and Internet Browsing Pack will also automatically be cancelled.
B. Minimum monthly spend for Unlimited BlackBerry® Email and Internet browsing Pack Products excludes any additional mobile device payments (if applicable).
Cancellation will take effect from the end of the month on which you tell us that you want to stop receiving the Vodafone Unlimited BlackBerry® Email and Internet browsing Pack Product. You will be billed until the end of that month.
C. Unlimited BlackBerry® Email and Internet browsing pack gives you unlimited BlackBerry data (BlackBerry® Internet Service (BIS) version only � excludes Blackberry® Enterprise Solution (BES) version) which includes BlackBerry® Email and Internet browsing, Facebook® and other applications, when accessed via the BlackBerry Access Point (APN) within Australia. Vodafone’s Fair Use Policy applies. Additional charges apply for some services such as video streaming (e.g. YouTube) and single file downloads over 3 MB. Included voice value cannot be used for data. Blackberry® handsets are 2100Mhz devices, except for BlackBerry® Bold 9700 which is a 900Mhz device. In 3G 900Mhz areas, all devices except the Bold 9700 will experience GPRS coverage (slower speed).

In addition to these terms and conditions, Research In Motion’s standard terms and conditions associated with the use of BlackBerry® from Vodafone, the BlackBerry® Internet Service, the BlackBerry® Built-In handheld and other associated products will also apply to your use of these products and services. BlackBerry®, RIM®, Research In Motion®, SureType®, SurePress™ and related trademarks, names and logos are the property of Research In Motion Limited and are registered and/or used in the U.S. and countries around the world. E. Unlimited BlackBerry® Email and Internet browsing (BlackBerry® Internet Service (BIS)) can only be activated on BlackBerry® Built-In handhelds as authorised by Vodafone and Research in Motion. The BlackBerry® browser icon or any specific application loaded on your BlackBerry® at the time of purchase (excluding Compass) must be used to access the internet to ensure data usage is taken out of your Unlimited BlackBerry® Email and Internet browsing Product’s included data allowance.
F. Download of applications from BlackBerry® App World™ is included in your Unlimited BlackBerry® Email and Internet browsing Product’s included data allowance, but the price for any application purchased is not included, and will be charged to you as an additional amount.
G. Data usage by some services available on Vodafone networks, including some internet services, cannot be paid from your Unlimited BlackBerry® Email and Internet browsing Product’s included data allowance. Use of these services may incur an additional charge, at the rates specified in the “Not payable from Included Handset Value” table in section 4.
H. Data allowances can only be used in Australia, on Vodafone networks.
